What is a month-to-month rental agreement?
A month-to-month rental agreement (also called a periodic tenancy) is a rental contract without a fixed end date. Rent is paid monthly and the tenancy rolls over each month on the same terms. Either party can end it with written notice, and the landlord can change the rent or terms with advance notice, always within the limits of local law.
It differs from our lease agreement template, which runs for a fixed term, and from our general rental agreement template. Use this version when flexibility is the main goal: short stays, a trial period before a long lease, or a tenant whose fixed-term lease has expired.
Key clauses in this template

How to customize this template
- Check notice rules — Look up the minimum notice to end a tenancy and to raise rent where the property is located. Some places require longer notice for landlords or a valid reason to end the tenancy.
- Confirm deposit limits — Many jurisdictions cap deposits and set strict return deadlines.
- Add required disclosures — For example lead paint, mold, flood risk or local rent registry notices.
- Define utilities clearly — List each utility so there is no question about who pays.
- Get a legal review — Have a local attorney check the final version, especially in rent-controlled areas.
