What Is an Equipment Rental Agreement?
An equipment rental agreement is a contract between an owner (often a rental company) and a renter who uses the equipment temporarily in exchange for payment. The owner keeps ownership at all times, while the renter is responsible for using the equipment properly and returning it on time and in the same condition, apart from normal wear. - Set clear rates and fees — Daily, weekly or event rates, delivery charges and late fees.
- Confirm operator requirements — Forklifts, lifts and other machinery may need certified operators under local safety rules, and vehicles or trailers may need registration or road permits.
- Check consumer and insurance rules — Damage waivers, deposit limits and liability clauses can be restricted for consumers in some places. Indemnities usually cannot excuse gross negligence or intentional misconduct.
