A loan for use agreement template helps you lend a property, vehicle, piece of equipment or other item to someone free of charge and get it back in the same condition. It records what is lent, what it may be used for, who pays for upkeep and when it must come back.

What Is a Loan for Use Agreement?
A loan for use is a free loan of a specific, identifiable thing for a particular use and period. Ownership stays with the lender, and the borrower must return the same item rather than an equivalent one. In English common law it is a type of gratuitous bailment; in civil law systems it is called a comodato (Italy, Spain, Brazil), a Leihvertrag (Germany) or a prêt à usage, also known as commodat (France).
Typical uses include letting a family member live in an apartment, lending a car or tools to a friend, lending equipment to a business partner or allowing a nonprofit to use a space. If you charge rent, use the rental agreement template or the lease agreement template instead.

How to Customize This Template
- Describe the item precisely — Include address, serial number, plate number or inventory, and attach dated photos.
- Be specific about use — “Residential use by the borrower and immediate family” is clearer than “personal use.”
- Allocate costs — List utilities, fuel, insurance, routine servicing or condominium fees the borrower pays.
- Check insurance — Make sure the lender’s policy covers use by the borrower, or require the borrower to insure.
- Check local formalities — Real estate loans may need registration, and vehicles may have insurance or registry rules. Local landlord-tenant law can apply if any payment is involved.
