LAWN CARE SERVICE AGREEMENT This Lawn Care Service Agreement (the “Agreement”) is entered into as of [Effective Date] (the “Effective Date”), BETWEEN: [Provider Name], with a principal place of business at [Provider Address] (the “Provider”); AND [Property Owner Name], with a mailing address at [Property Owner Address] (the “Owner”). The Provider and the Owner may be referred to individually as a “Party” and collectively as the “Parties.” 1. PROPERTY AND SERVICES The Provider will perform lawn care and grounds maintenance at [Service Property Address] (the “Property”). Included services: [Included Services] (for example, mowing, edging, string trimming, blowing of hard surfaces, fertilizing and seasonal leaf removal). Optional services, performed only when the Owner requests them and accepts a quote in writing: [Optional Services] (for example, snow removal, aeration, overseeding or hedge pruning). Any work not listed in this Section is outside the scope of this Agreement. 2. FREQUENCY AND SEASON Services will be performed on a [Service Frequency] basis during the following season: [Service Season]. The Provider may adjust the visit day for growth conditions, drought or routing, and will notify the Owner of any permanent change to the schedule. 3. PRICING AND PAYMENT (a) Price. [Pricing Method and Amount] (per visit or as a flat monthly fee for the season). (b) Invoices. The Provider will invoice the Owner on a [Billing Frequency] basis, listing the visits and any optional services performed. (c) Payment Terms. Invoices are due within [Payment Due Days] days of the invoice date. Overdue amounts may incur a late fee of [Late Payment Fee] where permitted by law, and the Provider may suspend services after written notice until the balance is paid. (d) Price Changes. The Provider will give at least thirty (30) days’ written notice of any price change that applies to a renewal term. 4. WEATHER AND RESCHEDULING Visits may be delayed or skipped because of rain, saturated ground, extreme heat, frost, storms or other unsafe conditions. Weather-delayed visits will be rescheduled within [Rescheduling Window] when practical. Under per-visit pricing, skipped visits are not billed. Under monthly pricing, the fee reflects an average season and is not reduced for occasional weather skips, unless visits are missed for reasons within the Provider’s control. 5. ACCESS TO THE PROPERTY The Owner will provide safe access to all service areas, including gates, codes and pet arrangements, as follows: [Access Instructions]. The Owner will keep pets secured during visits and remove toys, hoses, furniture and debris from the lawn. If the Provider cannot access the Property on a scheduled visit for reasons attributable to the Owner, the visit may be billed in full. 6. OWNER RESPONSIBILITIES The Owner will mark sprinkler heads, invisible pet fences, low-voltage lighting, buried cables and other hidden objects in service areas, and will inform the Provider about irrigation schedules, steep slopes and areas to avoid. The Provider is not responsible for damage to hidden objects that were not marked or disclosed. 7. PROPERTY DAMAGE The Provider will perform the services with reasonable care. The Owner must report any damage allegedly caused by the Provider within [Damage Reporting Period] days after the visit, with photos where possible. The Provider will repair, or pay the reasonable cost of repairing, damage caused by its negligence. The Provider is not responsible for pre-existing conditions, normal wear, or damage caused by weather, pests, plant disease or the Owner’s irrigation practices. 8. FERTILIZERS, PESTICIDES AND SAFETY (a) Products. Fertilizer, herbicide, insecticide or other product applications will be performed only if listed in Section 1, following label directions and applicable law. (b) Licensing. Where local, state or national law requires it, pesticide applications will be performed by or under the supervision of a licensed or certified applicator. Applicator license or certification number: [Pesticide License Number]. (c) Notice. The Provider will give any advance or post-application notice required by law, including recommended re-entry times for people and pets. The Owner will tell the Provider about wells, ponds, vegetable gardens or household members with chemical sensitivities. (d) Safety. The Provider is responsible for the safe operation of its equipment and for the use of appropriate protective equipment by its personnel. 9. INSURANCE AND LICENSES The Provider will maintain general liability insurance and, where required, workers’ compensation coverage, as follows: [Insurance Coverage]. The Provider will provide a certificate of insurance on request and represents that it holds the business and trade licenses required where the Property is located. 10. INDEPENDENT CONTRACTOR The Provider is an independent contractor and controls the means and methods of the work, its personnel and its equipment. Nothing in this Agreement creates an employment, partnership or agency relationship between the Parties. 11. TERM, AUTO-RENEWAL AND CANCELLATION (a) Term. This Agreement begins on the Effective Date and continues for [Initial Term]. (b) Auto-Renewal. Unless either Party gives written notice of non-renewal at least [Renewal Notice Period] days before the end of the current term, this Agreement renews automatically for a term of the same length, subject to any price change notified under Section 3. Where applicable law requires a renewal reminder, the Provider will send it. (c) Cancellation. Either Party may cancel this Agreement for convenience with [Cancellation Notice Period] days’ written notice, or immediately for a material breach not cured within ten (10) days after written notice. The Owner will pay for services performed through the cancellation date. (d) Consumer Rights. Nothing in this Agreement limits any cancellation or cooling-off right that applicable consumer protection law gives the Owner. 12. LIMITATION OF LIABILITY Except for damage caused by gross negligence or willful misconduct, or where the law does not allow a limitation, each Party’s total liability under this Agreement is limited to the amounts paid or payable under this Agreement during the twelve (12) months before the claim. 13. GOVERNING LAW This Agreement is governed by the laws of [Governing Law / Jurisdiction], without regard to conflict-of-law principles. The courts located in [Governing Law / Jurisdiction] will have jurisdiction over disputes arising out of or relating to this Agreement, unless the Parties agree in writing to try mediation first. 14. GENERAL PROVISIONS (a) Entire Agreement. The Provider may not assign this Agreement without the Owner’s prior written consent, except to a successor that acquires its lawn care business. (e) Counterparts and Electronic Signatures. This Agreement may be executed in counterparts, including by electronic signature, each of which will be deemed an original.
